Using mobile phones or audio devices while driving is considered as a life threatening behavior to road users, so it will be fined heavily

Decree 100/2019 / ND-CP prescribes an administrative punishment in the field of railway and road traffic taking effect from January 1, 2020, considers that using mobile phones when driving is a dangerous behavior and punishing by much money . Moreover, driver's driving license could be taken away.

Specifically, Point a, Clause 4 of Article 5 of Decree 100/2019 / ND-CP  prescribes a fine from VND 1 million to 2 million VND  to car drive using mobile phone while driving. Driver's driving license may be taken away from 01 to 03 months; from 2 months to 4 months if causing a traffic accident (Points b and c, Clause 11, Article 5).

Point h, Clause 4, Article 6 of the Decree prescribes a finefrom 600,000 VND to 1 million VND for motorcyclists using mobile phones while driving. Additional fine level is being deprived from driving licenses from 01 month to 03 months (Point b, Clause 10, Article 6).

Bicycles and electric bicycle riders are also fined from 80,000 to 100,000 VND for the same behaviors specified in point h, clause 1, Article 8 of Decree 100 / 2019 / ND-CP.

Decree 100/2019 / ND-CP determines clearly that only the behavior of manual using a phone while driving car must be fined.

Drivers using the phone through car connections such as Bluetooth, Apple CarPlay or Android Auto,… will not be fined.

Any cases of driving license being taken away but the driver still drives on the road will be considered as not having driving license. Thus, this fault will be punished as a driver without a driving license. Additionally, there will be an extra punishment such as detaining vehicle or vehicle documents temporarily depending on the violation.
